Champ Website - Terms of Use
This User Agreement is a contract between you and the Vulnerable Childrens Fund (Pty) Ltd trading as Champ and applies to your use of the website wwwchampfund.org and any related products and services available through the website. If you do not agree to be bound by the terms and conditions of this agreement, please do not use or access our services.
You must read, agree with, and accept all of the terms and conditions contained in this agreement and the privacy policy, which include those terms and conditions expressly set out below and those incorporated by reference, before you may make use of Champ's services. We may amend this Agreement at any time by posting the amended terms on our site. In this agreement, "you" or "your" means any person or entity or authorized representative making use of the Champ services ("Users"). Unless otherwise stated, "Champ", "we" or "our" will refer collectively to the Vulnerable Childrens Fund (Pty). "We" indicates Champ and "you" indicates any person or entity using the Service.
Introduction
The Champ website allows donors to learn about the work of projects and make payments to any of them, and is designed to introduce prospective donors and projects/events to one another. Projects are accepted at Champs’s discretion and are not required to be registered charities or non-profit organizations although most of them will be in order for us to comply with our status as a Public Benefit Organisation (PBO). If a project is registered as a charity or non-profit organization, the PBO registration number is quoted on the page describing the project. Champ shows projects on their website in order increase their exposure to prospective donors. Donors, in turn, may browse Champ to find projects and/or events that they wish to support.
Champ's Objective
We, together with our partners, wish to combine our resources in order to provide a platform for charity organisations to promote their cause for vulnerable children and also to identify and support specific projects that Champ wishes to support.
Our aim is to enable you to identify projects where you can get involved. You can make a difference in the lives of these vulnerable children by donating funds or goods or sponsoring these children or OVC (Orphans and Vulnerable Children) projects.
Legal Relationships
Champ acts as a facilitator to raise sponsorships for projects from donors and to help raise funds for charity events.
Abusing the Site
All users of Champs’ website agree to immediately report any suspicious, dishonest, misleading or fraudulent activity on this site. Champ will investigate all such claims. Any user found to have posted false or misleading information will be banned from further use of this site. Champ reserves the right to remove any user, organization or cause it deems as inappropriate, at its sole discretion.
Correspondence from Champ
All users of Champ agree to receive periodic e-mail announcements from Champ on policy changes, software updates, and/or functionality enhancements. Knowledge of these may be required for proper use of Champ. We respect your privacy. All notices to users will be sent by e-mail or will be posted on the Champ web site. When providing notice by e-mail, we will send notices to you at the e-mail address maintained in user records. All users must monitor their e-mail messages frequently to ensure they are aware of any notices sent by us. E-mail notices are deemed written notices for all purposes for which written notices may be required. E-mail notices are deemed received the business day after transmission if properly addressed to the intended recipient.
Confidentiality
Unless required by law, you will treat Champ's intellectual property as confidential and proprietary, and not disclose them to anyone without Champ's prior written consent. You may not use Champ's trademarks and advertising without Champ’s permission, and then only in ways agreed to by you and Champ. Upon termination of this agreement, you will promptly return any of Champs's property in your possession.
Linking to Champ
You may provide links on your web site directing visitors to Champ. To assist you in creating such links, we may make available graphical artwork, software, or other services to facilitate accurate tracking, reporting, and processing of payments. We grant you a nonexclusive, revocable right to use the above tools solely to create and maintain links to the Champ website. You may not modify the graphic image or text, or any other of our images, in any way. Although you may use text links to Champ on your web site, you may not use a graphic image or image-related text other than that which we provide. We reserve all of our rights in the graphic image and text, any other images, our trade names and trademarks, and all other intellectual property rights. You will be solely responsible for the development, operation, and maintenance of your site and for all materials that appear on your web site and for the information you may supply to be displayed on Champ.
No Spamming
To protect the integrity of the reputation of the Champ website as well as the Champ name, you may not promote your participation in the Champ service via certain forms of indiscriminate advertising, commonly referred to as "spamming." Accordingly, you may not promote or include any Champ links via unsolicited commercial e-mail (UCE), postings to non-commercial newsgroups, or cross-postings to multiple newsgroups at once.
Data
In order to provide the highest level of service to all Champ users, data provided by you for processing will be combined with data from all Champ users. Ownership of the combined database remains with Champ. Credit card and other account information from Champ's database will not be provided to you or any other party during this agreement or upon termination of this agreement. You are responsible for maintaining a record of all account information for your own use as well as for backup in the event of a system failure that requires restoration. Any attempt to gain access to Champ's database or systems by you, or anyone directly or indirectly associated or related to you, however remotely, will constitute a material breach of this agreement. In the event of any such attempt to gain access, Champ may immediately terminate this agreement, and you will immediately return to Champ all copies of any information obtained by this access.
Security Features
Champ strongly suggests that you use a web browser with 128-bit encryption. However, regardless of whether you use a web browser with security features, Champ is unable to guarantee that data transmitted is secure and/or will not be intercepted by third parties.
Your Password
When you register with Champ, you choose a password for use whenever you visit the site. You are responsible for maintaining the confidentiality of your password. If you become aware of any unauthorised use of your password, we recommend that you change it by amending your personal details online.
Tax Information
Champ is not an accounting, taxation or financial advisor, and you should not rely on information given on the site to determine the accounting, tax or financial consequences of making a payment or donation to Champ. We strongly recommend that you consult your own advisor about any accounting, taxation or financial consequences that may affect you.
Donations
Champ is registered with South African Revenue Service (SARS) as a Public Benefit Organisation (PBO). Donations made to PBO charities registered in South Africa qualify for an income tax deduction in terms of relevant South African tax legislation and Income Tax Certificates will be issued to all taxpayers on request.
Donor Eligibility
In order to use the service, donors must be at least 18 years of age. If you are under the age of 18, you hereby represent that you are using the service with the consent of your parent or guardian.
It is Champ's assumption that you have determined that using Champ’s website violates no laws or regulations in your country and jurisdiction. You warrant that you are violating no law or regulation by your use of our website, and you indemnify us for any and all liability that might arise from your use of our website.
Donor Registration
When making a payment to sponsor a project listed on Champ, you have to perform a simple, one-time registration. This includes providing us with your name and contact information and some personal details. You then choose a unique password, which you may use at any time to access the site and track your donations online. You authorise Champ, directly or through third parties, to make any inquiries we consider necessary to validate your registration. This may include ordering a credit report and performing other credit checks or verifying the information you provide against third party databases.
No Multiple Accounts
Should you register for more than one Champ account, Champ reserves the right to terminate all of your accounts and will restrict you from the system. You may register and hold one Champ account only.
Payments
Payments to Champ can be made either using a valid credit card account or via a debit order. In order to authorise recurring monthly payments you have to apply on line and complete a credit card authorisation/debit order authorisation form and fax through to us. For once off payments you can do so by paying on line using a credit card via a third party service provider. Champ reserves the right to resubmit for collection any transfers authorised by you that is returned for insufficient or uncollected funds.
Use of your donation
Champ is not responsible for any dissatisfaction you may have regarding the recipient organisation's use of any donation you may make through our website or websites powered by us.
Donor Fees
There is no charge for donors/sponsors to use our services. Champ charges no transaction fees on donations made on this website.
Unauthorised Card or Account Use
When a payment is made the transaction is final and not disputable unless unauthorised use of your payment card or account is proved. If you become aware of fraudulent use of your payment card or account, or if your card is lost or stolen, you must notify your card provider or bank in accordance with its reporting rules.
It is very important that you contact us at once if you believe your login information or password has been compromised, or if someone has transferred or may transfer money from your account without your permission. Under applicable banking regulations, the extent of your liability for an unauthorised transaction is largely determined by your promptness in notifying us or your bank if someone has gained access to your password, or if a transfer or withdrawal in your monthly statement is incorrect or unauthorised. Notifying us quickly limits your liability.
You can inspect your transaction history at any time by logging in to your account on the Champ website. If your transaction history shows payments that you did not make or did not authorise, notify us at once. If you do not notify us within 60 days after receiving notice, you may not recover any money you lose after the 60 days if we can prove that we could have stopped someone from taking the money if you had notified us in time. If a good reason (such as a long trip or hospital stay) kept you from notifying us, we may extend the time periods.
In case of unauthorised transactions, payment problems, errors or questions about your account, you should notify Champ by e-mail.
You must:
1) Tell us your name and email address;
2) Describe the error or the transaction you are unsure about, and explain as clearly as you can why you believe it is an error or why you need more information; and,
3) Tell us the amount of the suspected error. If you tell us by telephone, we may require that you send your complaint in writing within ten (10) business days.
We will tell you the results of our investigation within ten (10) business days after we hear from you, and will correct any error promptly. If we determine there was no error, we will mail you an explanation within three (3) business days after we finish the investigation. You may ask for copies of documents which we used in our investigation..
Billing
Champ will appear on your account statement for all payments made to us. The name of the project/event you support will also appear on the account statements.
Champ shall make reasonable efforts to ensure that requests for electronic debits and credits involving bank accounts and credit cards are processed in a timely manner. However, a number of factors, several of which are outside of our control, will contribute to when the funds are received. We make no representations or warranties regarding the amount of time needed to complete processing, such as delays in the banking system, nor shall we be liable for any actual or consequential damages arising from any claim of delay.
Content
You understand that all opinions, text, photographs, illustrations, graphics, logos, audio clips, images, information, data, graphics, news articles, guides, software, messages, or other materials appearing on the service or submitted to the service are the responsibility of the cause, person or entity originating such content. Champ does not guarantee the accuracy, integrity, reliability or quality of the content on the service, and shall not be liable for the content on the service. Inclusion of such content does not imply any endorsement by Champ of any views, opinions, or beliefs expressed therein.
Trademarks
The names Champ, Champfund.org, the Champ logo and any other product and service names that we may present on the site from time to time may not be used in connection with any product or service that is not Champs's, nor in any manner that is likely to cause confusion, or in any way that may disparage or discredit Champ. Other trademarks, service marks or logos that appear on the site, in particular (but not exclusively) those of projects/events are the property of their respective owners and are likely to be registered trademarks and subject to restrictions as to their use. They must not be used without the express permission of both Champ and the trademark owner.
Copyright
All content on the Champ site is owned by Champ, our projects, or other original providers, and is protected by the applicable intellectual property and proprietary rights and laws. You may copy content for your own personal, non-commercial use provided you do not alter it or remove any copyright, trademark, or other proprietary notice. No other use of the site’s content is permitted without the express prior permission of Champ, and, where applicable, the copyright holder. No Warranties
Champ makes no express or implied warranties or representations with respect to the Champ services (including, without limitation, warranties of fitness, merchantability, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage). In addition, we make no representation that the operation of our site will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.
NONE OF CHAMP, ITS CONSULTANTS OR ITS AFFILIATES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF REVENUE, PROFITS OR DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Invalid or Unenforceable Provisions
If any provision of this Agreement is held to be invalid by a court of competent jurisdiction, then the remaining provisions will nevertheless remain in full force and effect. You and Champ agree to renegotiate in good faith any term held invalid and to be bound by any mutually agreed to substitute provision.
Entire Agreement & Modifications
This agreement sets forth the entire agreement and understanding between the parties and merges all prior discussion between them. Utilisation of the website by you following the effective date of any change or modification of this agreement will constitute acceptance by you of such change(s). Otherwise, this agreement may not be modified except by the written consent of both parties.
Governing Law
These Terms of Use are governed by South African law.
